California's Sexual Harassment LawAB1825 Compliance

Assembly Bill 1825 now requires that California employers with 50 or more employees (including temporary service employees and/or independent contractors) must provide 2 hours of sexual harassment training every 2 years for its supervisors on the prevention and correction of sexual harassment, discrimination, retaliation, and remedies available.

But any lack of training will probably be construed as a “reckless disregard” for the law.

1. Training Methods:

(1b) E-learning -- individualized, interactive, computer-based training that:

a. is written, developed, and approved by an instructional designer, qualified trainer or subject matter expert.

The trainer must be able to answer questions and provide guidance and assistance on the training issues within a reasonable time, but no more than two business days after the question.

2. Trainer/Developer Qualifications 

(2a) Subject Matter Expert (SME): is an individual who has legal education coupled with practical experience, or substantial practical experience in training in harassment, discrimination and retaliation prevention.
